1. subject matter and purpose of the contract

1.1 Livingtown AG operates serviced apartments (individually "Apartment" and collectively "Accommodation") and accommodates guests therein for a definite or indefinite period of time. These General Terms and Conditions of Contract ("GTC") apply to all legal relationships between Livingtown AG ("Livingtown") and its contractual partners ("Guest" and collectively "Parties").

1.2 With the accommodation contract, the guest is entitled to use the accommodation/apartment exclusively for private residential purposes and for the persons registered in the reservation confirmation. Letting or transferring the contract to third parties is not permitted.1.3 Commercial activities are not permitted in the accommodation/apartment. 1.4 These GTCS also govern the contractual relationship between Livingtown and the guest entered into with a separate accommodation contract. In the event of contradictions, the accommodation contract shall take precedence. The guest has read these GTC and confirmed their acceptance. Deviations from these GTC are only valid if they have been expressly agreed by the parties in writing or by e-mail.

2. conclusion of contract and cancellation

2.1 The binding booking of the apartment is made via the booking platform Res:harmonics ("booking platform"). Only guests registered on the booking platform are entitled to live in the accommodation and the guest confirms the accuracy of the personal details provided in the booking request. Livingtown forwards this information to the relevant authorities in order to fulfill its reporting obligations.

2.2 As soon as a reservation request from the Guest has been confirmed by Livingtown by email and/or app, the corresponding accommodation contract is concluded and binding. Failure to take up the accommodation is generally at the sole risk of the Guest.2.3 Livingtown reserves the right to provide the Guest with a replacement in the same property that is at least equivalent to the reserved apartment. An equivalent replacement is deemed to exist if the apartment is at least equivalent to the reserved apartment in terms of size, standard of furnishings, external living facilities (balcony) and inventory.

2.4 Cancellation is possible as follows:

Shortstay:

  • up to 7 days before agreed check-in: free of charge
  • up to 3 days before the agreed check-in date: 50% of the costs to be paid

Longstay and Unlimited:

  • up to 6 weeks before agreed check-in: free of charge
  • up to 4 weeks before the agreed check-in date: 50% of the cost of a one-month contract periodIn the event of a long-stay booking being canceled, the guest will be charged an additional fee of CHF 150. Special cancellation agreements with corporate partners remain reserved.

2.6 If the guest does not take possession of the apartment on the agreed check-in date and without prior cancellation, the apartment shall remain available for the period of time already paid for. After this period has expired, the apartment will be reassigned. In any case, the guest remains liable to pay for the remaining term of the contract, but any re-letting (less compensation for turnover) will be credited to the guest.

3. duration of contract and payments

3.1 "Shortstay": Minimum stay is 1 night, maximum up to 1 month; only the "Fancy Lofts" can be booked.

"Longstay": Minimum stay is 1 month, maximum up to 9 months. Only whole months can be booked. The bookable month is the period between the first day booked and the corresponding day before the following month.

"Residence": From a stay of 90+days or unlimited. Only whole months can be booked. The bookable month is the period between the first day booked and the corresponding day before the following month.

3.2 The notice period for an unlimited Unlimited booking is 3 months to the end of a bookable month. Notice of termination must be given by e-mail.

3.3 Prices and terms of payment: All prices are quoted in Swiss francs (CHF) plus the statutory value added tax (VAT) owed in each case. If the VAT rate is adjusted after the contract has been concluded, the VAT rate applicable at the time the service is provided shall apply.

3.4 The full amount for the booked service is due for payment upon confirmation of the reservation by Livingtown. In the case of a long-stay booking, the amount for the first month is due for payment. The remainder of the stay is due for payment on the first day of each new month booked. Special payment agreements with corporate partners remain reserved.

3.5 If the parties agree on payment by invoice, the entire amount shall be due for payment without deduction no later than 10 days after the invoice date.

3.6 In the event of late payment, Livingtown shall be entitled to charge default interest of 5% on the invoice amount and a reminder fee of CHF 40 (per reminder).

3.7 The conclusion of a security deposit insurance or a cash deposit in the amount of the price of 1 to 3 months is also due with the reservation confirmation. This deposit serves as security for late or improper return, including damage, missing inventory, additional cleaning, outstanding payments by the guest, etc. In the case of deposit insurance, Livingtown will only accept the deposit insurance specified in the booking process. This deposit insurance must be valid for at least 6 months beyond the end of the contract period and can be canceled at the earliest within 30 days of the return of the apartment, provided that all contractual obligations have been duly fulfilled and outstanding payments have been settled.

3.8 The means of payment specified on the booking platform shall apply. A service fee will be charged for credit card payments.

4. check-in

4.1 Mon - Sun: from 15:00 hrs. The guest is not entitled to earlier availability.

4.2 Early check-in can be booked for short-stay bookings subject to availability for the following fee:

  • Check-in between 9.00 - 12.00 a.m.: CHF 100.
  • Check-in between 12.00 - 15.00: CHF30.-/interrupted hour

4.3 Access to the apartments is via the "Salto KS" access app, for which the guest receives corresponding instructions after booking. However, access authorization to the apartment is only granted after receipt of all payment obligations of the guest.

4.4 A Welcome Desk is available from Monday to Friday from 15:00 to 17:00. Outside of these times, only online check-in on the booking platform takes place.

4.5 When moving into the apartment, it is the guest's responsibility to check the apartment and in particular the existing furniture and inventory for their condition and any defects and completeness. The Guest shall be provided with an inventory list for this purpose. If no defects or incompleteness are reported to Livingtown within 3 days, the guest accepts the existing condition as being in accordance with the contract.

5. check-out

5.1 Check-out shall take place by 11:00 a.m. at the latest.

5.2 The guest must vacate the apartment completely (including waste disposal) on the last day of the agreed contract period and leave it on time. In the event of late check-out by 18:00, Livingtown is entitled to charge 50% of the current daily rate. If there is no check-out by 18:00, the guest will be charged 100% of the daily rate. Livingtown expressly reserves the right to claim further damages due to late check-out.

5.3 The check-out takes place autonomously (self-check-out), for which purpose the guest is provided with a checklist for the self-check-out procedure in good time. These instructions must be followed.

5.4 After check-out and return of the apartment, Livingtown will carry out an inspection of the apartment. Damage or destruction of furnishings, inventory or permanently installed components that go beyond normal wear and tear and/or damage caused by improper use will be charged to the guest plus a flat-rate compensation for Livingtown's claims management.

5.5 Final cleaning is mandatory for Longstay or Unlimited bookings. The corresponding costs of a flat rate of CHF 250 will be charged to the guest together with the costs of booking the accommodation. Livingtown expressly reserves the right to charge additional costs for increased cleaning if the apartment is in an inappropriate condition (dirt, garbage, etc.).

5.6 Items left behind by the guest will only be forwarded on request and at the guest's risk and expense; without a report, such items will be disposed of within 60 days at the guest's expense.

6. reporting obligations during the stay

6.1 In the case of a Longstay or Unlimited booking, the guest is responsible for the local statutory reporting obligations to the authorities. In the case of a short-stay booking, the obligation to register is made directly via the booking platform.

6.2 The Guest shall inform Livingtown immediately and without being requested to do so of any changes with regard to surname and first name, marital status and residence status as well as changes to the passport or comparable documents (e.g. ID).

6.3 Any damage that has occurred or is about to occur in the apartment (fixed components, furniture and inventory) must be reported by the guest immediately so that it can be repaired in good time.

7. services "inclusive"

7.1 The following services are automatically included in the basic price:

  • Operating costs: Operating costs such as heating, electricity, hot/cold water are included in the price. If excessive consumption is determined, Livingtown is entitled to charge the guest for costs exceeding the usual consumption at its own discretion.
  • Furniture and equipment: Each apartment is equipped with Wi-Fi, TV, furniture, bed incl. bed linen, a kitchen with the usual accessories (crockery, cutlery, kitchen utensils), home textiles (bath and hand towels, dish towels).
  • General in-house facilities: These are intended exclusively for guests and their registered companions and are used on a first come, first served basis. Reservations are possible in individual cases and in accordance with separate house rules.
  • Common rooms (e.g. kitchen): Are to be used exclusively for normal leisure activities of the guests and their companions. For example, no commercial, political, religious or other public events may be held.
  • Linen change: 1x a week
  • Standard cleaning: 1 x week. The guest must allow access at the specified time, otherwise cleaning will be omitted without compensation.
  • Letterbox: Each apartment has a lockable letterbox. The letterbox is labeled exclusively by Livingtown. The guest is responsible for the regular emptying of the mailbox. Livingtown accepts no liability for the delivery of mail. After check-out, the guest is responsible for redirecting and forwarding their mail; Livingtown is not obliged to store or forward mail.
  • Welcome Desk: Personal contact person during opening hours. Communication with the Customer relationship manager at any time via app.

7.2 The voluntary waiver of "inclusive" services does not entitle the guest to a price reduction or other claims.

7. services "on demand"

8.1 The following services are not included in the basic price and can be used for an additional fee:

  • In-house: catering and Vending machine, fitness facilities, use of conference rooms, additional cleaning and mobility services.
  • Services provided by external partners: will be presented at check-in and Livingtown will endeavor, without obligation, to negotiate a preferential price for its guests in advance if possible. 8.2 The prices quoted by Livingtown or an external partner apply. Services "on demand" must always be paid for in advance. In the case of long-term use of services, payment in installments can be agreed in consultation with Livingtown.

9. code of conduct (due diligence obligations)

9.1 The following code of conduct is binding for all guests and their visitors to ensure an all-round pleasant stay in the Livingtown accommodation:

9.2 The guest shall use the accommodation and the apartment carefully and observe the existing operating instructions when using the MOVE-ment module. Before commencing a Longstay or Unlimited booking of at least 3 months, the guest must take out and present appropriate liability insurance (for shorter contract periods, the guest is covered by Livingtown's public liability insurance).

9.3 The guest shall behave considerately towards other guests and neighbors. Room volume applies from 10 pm. Making music is not permitted at any time.

9.4 Visitors are welcome at any time. Guests are responsible and liable for ensuring that their visitors comply with the duties of care and consideration set out in these GTC and the house rules.

9.5 Smoking is prohibited in the apartment and inside the accommodation.

9.6 Pets are not permitted.

9.7 Guests must dispose of their waste in the waste room. Waste garbage cans in the communal areas may not be used for this purpose.

9.8 In all other respects, the house rules of the respective accommodation apply. Livingtown reserves the right to amend the house rules at any time.

9.9 In the event of non-compliance with this code of conduct, the right to take action in accordance with Clause 10 is expressly reserved.

10. breach of contract / premature termination of contract

10.1 Breach of duty of care and outstanding payments. The breach of the essential obligations regulated in the accommodation contract or these GTC by the guest or his visitors entitles Livingtown to terminate the contractual relationship without notice. In this case, the apartment must be vacated by the guest within 24 hours of receipt of the notice of termination in accordance with the contract:

  • Repeated noise, odor or other disturbing nuisance from other guests, their visitors or neighbors. In the event of a serious incident (e.g. involving the police), a single disturbance is sufficient.
  • Violation of the applicable house rules In the event of a serious incident (e.g. police intervention), a single violation is sufficient;
  • breach of the guest's reporting obligations (see Section 5);
  • Exceeding the registered number of guests (excluding occasional visitors);
  • Payment arrears of at least 7 days after the due date.

10.2 The Guest is fully liable for the costs incurred by Livingtown in connection with the premature termination of the contract.

10.3 Eviction. If the guest fails to vacate the apartment on time or completely at the end of the contract (ordinary termination of the contract or as a result of termination without notice), Livingtown is entitled to enter and vacate the apartment. The guest's access authorization will be blocked. Any valuables in the apartment shall become the property of Livingtown as security for claims. All other items will be disposed of without compensation.1

11. withdrawal from the contract before occupation

11.1 Livingtown is entitled to withdraw from the contract before the guest moves into the apartment under the following conditions:

  • Non-payment of agreed advance payments by the guest before the check-in date;
  • if the guest provides misleading or false information when booking or if their stay is illegal;
  • if force majeure (strike, war, pandemics, storms, etc.) or other circumstances for which Livingtown is not responsible make it impossible to fulfill the contract;
  • The guest is not entitled to any claims in the event of a justified withdrawal from the contract by Livingtown.

11.2 In addition to the right of withdrawal, we reserve the right to claim damages in the event of culpable behavior on the part of the guest.

12 Further provisions

12.1 Right of access and inspection. Livingtown is entitled to enter the apartment at any time for repair and maintenance work or reservation enquiries. The guest will be informed in advance with reasonable notice (at least 24 hours), subject to emergencies.

12.2 Communication: Communication between the guest and Livingtown takes place in writing via e-mail and the Community Portal (app etc.).

12.3 Exclusion of liability. Livingtown accepts no liability whatsoever for items brought into the accommodation by the guest (theft, loss, damage, etc.).

12.4 Surveillance camera Livingtown may set up surveillance cameras in the general accommodation areas on a case-by-case basis and for the safety of guests and property (e.g. in the case of a vending machine). The guest hereby explicitly consents to this surveillance.

12.5 Amendments to these GTCS Subsequent amendments or additions to these GTCS shall be published on the booking portal. They shall become part of the contract if the guest does not object within 30 days of becoming aware of the amended GTC.

12.6 Applicable law, place of performance and place of jurisdiction. The contractual relationship between the parties shall be governed exclusively by substantive Swiss law. The applicability of the CISG is excluded.place of performance is at the location of the booked accommodation.place of jurisdiction for all disputes is at the location of the accommodation booked by the guest.
